Trademark Renewal

Trademark owners have the opportunity to renew their trademark every ten years. Before the decade is up, the Registrar provides a six-month grace period for trademark holders to initiate the renewal process and benefit from it. If they fail to do so, the Registrar will announce the removal of the trademark in the Trademark Journal.

Trademark Renewal Provision (Section 25)

As per the Trade Marks Act of 1999, a registered trademark can be renewed for another ten years following the end of the initial registration or the latest renewal. To start the renewal process, the trademark owner must submit an official application to the Registrar of Trademarks within the specified timeframe and adhere to the established guidelines. Once the application and required fee are submitted, the Registrar will extend the trademark's registration for another decade.

Deletion of Registered Trademark Due to Non-Renewal (Section 25) 

The Registrar is required to inform the trademark owner of the impending expiration and the conditions for renewal before registration ends. If the renewal terms are not fulfilled within the allowed period, the Registrar has the authority to remove the trademark from the register.

However, a grace period of six months after the expiration date is provided. During this time, the trademark owner can still renew their mark by paying a surcharge along with the standard renewal fee. Furthermore, if a trademark is delisted due to non-payment of the renewal fee, the owner can seek reinstatement within one year of the registration's end date. Upon receiving the application and the necessary fee, the Registrar may reinstate and renew the trademark, possibly with certain conditions or limitations.

Methods of Trademark Renewal 

You can renew your trademark in one of two ways: 

  • Renew with changes: This option allows you to modify specific elements of the existing trademark during the renewal process. 
  • Renew without changes: This option extends your trademark as it is, without any alterations to its design or wording. 

Restoring Your Trademark 

If your trademark lapses after ten years, don’t worry—you still have options. You can go for trademark restoration, which is similar to the renewal process but comes with an additional fee for missing the renewal deadline. 

Trademark Renewal Filing Deadline 

  • It's important to file your trademark renewal application before the trademark expires. You can start the renewal application up to a year in advance, but the official cutoff is six months before the expiration date. 
  • If your trademark registration lapses due to non-renewal, you can still renew it within six months of expiration, although this will incur an extra fee on top of the usual renewal charge. 
  • If renewal doesn’t happen before expiration or within the following six months (with the added fee), the trademark registration will be cancelled. However, if a trademark is cancelled, there is a chance for restoration by submitting a reinstatement application within six months of cancellation. 

Documentation Needed for Trademark Renewal 

When renewing your trademark online, make sure to include these documents with the TM-12 renewal form when you submit it to the Registrar of Trademarks (RoT): 

  • A certified copy of your original trademark registration certificate. 
  • A certified copy of the TM-A form from your initial trademark registration. 
  • Identification proof for the applicant. 
  • Proof of residence for the applicant. 
  • If you're representing the trademark owner, a Power of Attorney is required.
